Terms and Conditions of Sale

  1. Acceptance of Terms

    1. By using the Stop Intruders (Registered Company: SOLD SIMPLY Ltd, Company reg: 12802354) website you agree to these terms and conditions. Stop Intruders reserves the right from time to time to modify, update and alter the terms and conditions, product descriptions and pricing information. You agree to be bound by these terms on current and subsequent visits. Placement of an order with Stop Intruders is deemed as acceptance of these terms and conditions. 

  2. Stock availability

    1. All purchases are subject to stock availability. 

    2. Should Stop Intruders be unable to dispatch goods in a timely fashion, we endeavour to contact you within forty-eight (48) hours to advise of any delays, provided accurate contact details have been provided.

    3. Goods not supplied will not be charged for, and any goods not received will be refunded in full.

  3. Manufacturer’s warranty

    1. Stop Intruders offer a 1-year manufacturer’s warranty on delivery, the goods shall conform in all material respects with their description and shall be free from material defects in design, material and workmanship. Should a fault arise within the warranty period, the Buyer should give notice in writing to Stop Intruders at contact@sold-simply.co.uk within a reasonable time of discovery that some or all of the goods do not comply with the warranty.

    2. To process a return, the Buyer must contact Stop Intruders at contact@sold-simply.co.uk  where a Warranty Returns Form will be provided. All warranty return parts are sent at the Buyers cost and must be received by Stop Intruders no later than 30 days from notice received from the Buyer, parts received after 30 days will be returned to the Buyer.

    3. Stop Intruders shall, at its option, repair or replace any such goods (other than consumable items) found to be defective as a result of faulty materials or workmanship within the warranty period or refund the price of such goods in full.

    4. A claim under warranty in respect of any delivery or instalment of any order or any part thereof shall not entitle the Buyer to cancel or refuse delivery of or payment for any other order, delivery or instalment or any part of the same order, delivery or instalment.

  4. Limitation of Liability

    1. Nothing in these terms and conditions shall limit or exclude Stop Intruders liability for:

Death or personal injury caused by its negligence, or the negligence of its employees, agents or subcontractors (as applicable);

Fraud or fraudulent misrepresentation;

Breach of the terms implied by section 12 of the Sale of goods Act 1979;

Defective products under the Consumer Protection Act 1987; or

Any matter in respect of which it would be unlawful for Stop Intruders to exclude or restrict liability.

    1. Stop Intruders make no representation that goods will prevent personal injury or property loss or that the goods will in all cases provide adequate warning or protection. The Buyer should understand that a properly maintained sound barrier may only reduce the risk of burglary, it Is not a guarantee such will not occur or that there will be no personal injury or property loss as a result. THEREFORE, STOP INTRUDERS SHALL NOT BE LIABLE FOR ANY CONSEQUENTIAL OR INCIDENTAL DAMAGES IN CONNECTION WITH THE USE INSTALLATION AND/OR MAINTENANCE OF THE PRODUCT. Including but not limited to the liability for any property damage, bodily injury, or other loss based on a claim that the product failed to give warning or operate as expected, or any cost of expense of providing substitute equipment or service during periods of malfunction, non-use or maintenance 

    2. The total liability of Stop Intruders to the Buyer in respect of all other losses arising under or in connection with a contract, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, shall in no circumstances exceed 100% of the price of the goods which are the subject of the contract.

  2. Order Acceptance

    1. Acceptance of an order is only acceptance once a confirmation of receipt of order has been sent. Stop Intruders however reserves the right subsequently not to supply goods should we have reasonable grounds not to do so

  3. Placing Orders and Payment

    1. If you are a Buyer with a bespoke or enterprise level requirement, quotations can be requested by contacting contact@sold-simply.co.uk. Quotations given by Stop Intruders shall remain open for orders to be placed on them for a period of 30 days from the date of the quotation, unless in the quotation some other period is specified and unless the quotation is withdrawn by Stop Intruders

    2. All goods are sold “ex works” unless we agree otherwise. If Stop Intruders undertakes or arranges carriage, insurance and other transport the Buyer accepts this at their expense.

    3. BACS or wire transfers are available for enterprise level Buyers, all payments are on a Pro-Forma basis, once confirmation of funds clearing has been verified, goods will be released for shipment.

  4. Risk and Title of Goods

    1. Where Stop Intruders have organised the delivery of a Buyer order, it is the responsibility of the Buyer to advise Stop Intruders of any product damages or discrepancies within two working days of receipt of goods, this will be via email to contact@sold-simply.co.uk. Reports of damages or discrepancies are advised after two working days, it will be assumed that this occurred after delivery and will become the responsibility of the Buyer. Where the Buyer has organised the collection of an order, the risk in the goods shall pass directly to the Buyer on departure from Stop Intruders premises and the Buyer will be wholly responsible for any damages or discrepancies which occur during transit.

    2. In the event credit terms have been offered to an enterprise Buyer, goods shall not pass to Buyer until full payment has been made for the goods and shall be expected to:

      1. Store the goods separately from all other goods held by the Buyer so that they remain readily identifiable as Stop Intruders property

      2. Maintain the goods in satisfactory condition and keep them insured against all risks for their full price from the date of dispatch from Stop Intruders facility

  5. Delivery

    1. All goods will be shipped via the preferred Stop Intruders carrier and tracking information will be provided to the Buyer when possible.

    2. For any issues regarding condition of goods on receipt for website order please refer to ‘Risk and Title of Goods’.

  6. Returns Policy

    1. If you the Buyer decide you do not wish to retain the goods, you have the right to return the goods within a 7 days period of receipt. 

    2. The goods must be unopened, undamaged and returned to Stop Intruders at the Buyers expense and risk. 

    3. Full refund will be processed on receipt and inspection of the goods. If the goods are found to be damaged or require repair, this may result in no refund being returned, or partial refund to be assessed on the value of damage of the returned goods.

  7. Governing Law

    1. These Terms and Conditions between Stop Intruders and you (the Buyer) shall be governed by, and construed in accordance with English Law.

  8. Jurisdiction

    1. Any dispute relating to these Terms and Conditions which cannot be resolved by negotiation between the Stop Intruders and you (the Buyer) within 60 days of either party having given notice to the other party that a dispute whether contractual or otherwise shall be subject to the jurisdiction of the courts of England or Wales.
